Final settlement in the Netherlands: how to recover all your accumulated money when you leave the agency

When a worker decides to end their time working in the Netherlands and pack their bags to return to Spain, they usually make the same miscalculation: thinking the exit process is the same as in their home country. In Spain, on the day you sign off, the company gives you a cheque or a transfer with your final settlement, hands you your settlement statement and the relationship ends immediately.

If you expect that to happen in the Dutch labour market, you are heading straight for a financial panic attack at the airport.

Official government websites (such as Work in NL ) talk about dismissal for permanent contracts and transition payments ( Transitievergoeding ) that almost never apply to temporary workers. Generic job portals translate the law into flat, boring language that doesn't answer your practical questions. None of them explain the reality of the logistics and industrial sector regulated by employment agencies. None of them tell you where the money that has been legally withheld from you week after week is and, most importantly, none of them warn you about the time limbo your money is going to end up in.

1. The concept of the Eindafrekening : what is the Dutch final settlement really?

In the Netherlands, the equivalent of the final settlement is not compensation for leaving the company; it is called the Eindafrekening (final settlement of accounts).

When you work through an agency, especially under the ABU or NBBU collective agreement in the flexibility of Phase A (or Phases 1 and 2), your direct pay is not the only thing you generate. For every hour you spend packing boxes, driving an electric pallet truck (EPT) or picking orders, the agency's computer system opens virtual piggy banks in your name. These piggy banks are called Reserveringen (reserves).

The Eindafrekening is not a gift from the company or a bonus for good behaviour; it is the act required by law in which the agency has to break open those piggy banks, add up all the withheld money that rightfully belongs to you and transfer it to your bank account.

The big strategic difference from the southern European system is that the agency will not pay you this money on the last day you clock in at the warehouse. The Dutch tax and administrative system requires a closing audit process that we will look at later, which means your final settlement will be processed later on.

2. The 3 pillars of your final settlement: where is your money kept?

To check that the final settlement statement the agency sends you is correct, you need to fully understand which items have been building up in your reserve funds during your months of service. If you can't read these three pillars in your employee portal, you are completely defenceless against a possible error by the agency.

A. Untaken holiday days ( Vakantiedagen )

For every full month you work full time in the Netherlands, you build up a percentage of paid holiday days (under the collective agreement, usually just over 25 days a year). If during your time at the warehouse in Tilburg or Venlo you kept working without asking for weeks off, all those days build up as money in your virtual piggy bank.

The calculation: when your final departure is processed, the agency must calculate how many hours of holiday you have accumulated in your reserve balance and pay them at the exact rate of your current regular hourly wage.

B. Holiday pay ( Vakantiegeld )

Don't confuse holiday days with holiday pay. Vakantiegeld is a statutory right in the Netherlands. It is equivalent to 8% of all the gross salary earned during the year.

The general rule: this money is usually paid to all workers in the country in May to help cover summer expenses.

In the final settlement: if you decide to end your contract and leave the country in any other month (for example, in October or February), the agency is legally obliged to pay out the proportional part of the Vakantiegeld you have built up since last May until your last actual working day.

C. National holidays and short absence ( Feestdagen / Kort verzuim )

This is another small but very profitable piggy bank. In hourly Phase A contracts, a small percentage is withheld to cover official Dutch public holidays (such as King's Day or Christmas) when the factory closes but you are entitled to be paid for your working day. If you leave the company and haven't used these reserve funds to cover long weekends or public holidays, that accumulated balance must be added in full to your final transfer.

3. The 6-week period: why you don't get your money on your last day

This is where 90% of Spanish workers panic and start bombarding their coordinators with complaint messages. They finish their last shift on a Friday, the following Wednesday they see that their usual transfer is lower than normal or doesn't arrive, and they assume the agency has scammed them.

You need to understand how Dutch administration works realistically: Dutch law gives employment agencies up to 6 weeks to pay the final settlement.

Why does the system take so long to close?

It is not a manoeuvre by the agency to keep your funds or delay your payments on a whim; it is a security requirement of the social security system and of the logistics clients' controls:

Audit of hours: the warehouse where you worked must send the final clocking records to the agency's head office. If there was overtime or night work in your last three days, this data takes time to be cross-checked.

Tax adjustments: the Belastingdienst collection software must calculate the tax closure of your income for the year to apply the exact withholdings, preventing you from ending up with outstanding debts to the state.

Closing housing and transport: if you used the agency's house or vehicles, it must be checked that there are no outstanding costs for damage or extraordinary consumption before your reserve money is released.

So when you leave, assume in your financial planning that this money will take a month and a half to appear in your Spanish or Portuguese bank account. Count on it as a deferred savings cushion for your return.

4. Accommodation and the end of a Phase A contract

With the flexibility of Phase A contracts with an agency clause ( uitzendbeding ), the employment relationship and the right to residential accommodation are usually completely linked. This creates a highly vulnerable situation if you decide to leave on bad terms or are dismissed for disciplinary reasons.

The deduction of the last rent

When the agency prepares your Eindafrekening , the first thing it will do is settle the accounts for the services it has provided. If you have been living in its SNF-certified complexes until the last day, the corresponding weekly rate will be deducted from your accumulated balances.

The accommodation deposit ( Borg )

If you had to pay a deposit when you moved into agency accommodation to cover possible damage to the room, this money is not returned to you in cash when you hand in the keys. The housing coordinators will carry out a visual inspection of the room after you leave. If everything is clean, in order and there is no structural damage to the furniture, the full amount of the deposit will be added as a positive item in the breakdown of your 6-week settlement document.

5. Cómo reclamar si la agencia «se olvida» de tus derechos

Los Países Bajos tienen un mercado laboral fuertemente regulado, pero como en cualquier parte del mundo, existen agencias «pirata» o de dudosa reputación que intentan aprovecharse del desconocimiento idiomático y legal de los trabajadores que regresan al sur de Europa. The role of the SNCU: the agency police

In the Netherlands you are not helpless. There is a key independent body called the SNCU ( Stichting Naleving CAO voor Uitzendkrachten ). It is, literally, the foundation for monitoring compliance with the collective agreement for temporary workers.

If you send a formal complaint to the SNCU showing that an agency covered by the ABU or NBBU agreement has not paid out your Reserveringen or your Vakantiegeld within the legal deadlines, this body will start an internal audit of the agency. The fines agencies face for violating workers' settlement rights are so damaging that 99% of companies will settle your payment within days, before the SNCU opens a formal file.

6. Frequently Asked Questions (FAQ) about the final settlement in the Netherlands

Is more tax deducted from the final settlement transfer?

What happens to my pension fund (STiPP) when I leave the Netherlands?

The mandatory pension fund for agency workers ( STiPP ) is not included in the 6-week settlement the agency pays you. That money doesn't belong to the agency; it is kept safely in a Dutch national pension fund in your name. When you leave the country, that capital stays frozen, earning returns for your future retirement. If you decide not to return to work in the Netherlands, when you reach the legal retirement age in Spain you can apply to transfer those funds or receive your accumulated Dutch pension monthly, completely legally.

Am I entitled to a final settlement if I decide to leave voluntarily?

Absolutely. The final settlement in the Netherlands ( Eindafrekening ) is not compensation for unfair dismissal; it is the payout of your holiday money and extra pay that you have already earned yourself. It makes no difference whether you are dismissed due to lack of work at the warehouse, commit a disciplinary offence or are the one who decides to end the contract overnight because you want to return to Spain: the agency is legally obliged to break open your reserve piggy banks and transfer every last cent you have built up.

Can I demand that the settlement be paid into a Spanish bank account?

Yes. Under the banking rules of the European Union's SEPA zone, Dutch employment agencies must accept any European IBAN for your final transfers. If you decide to close your Dutch bank account (such as Bunq or ING) before you leave, make sure you notify your agency manager in writing of your Spanish account number so the final transfer is made there without administrative delays.
